New Haven lawsuit involving lead cases moving to special court docket

The city has asked that two lead cases be consolidated and moved to another court, while the plaintiffs said New Haven misunderstands the intent of the legal action.

Attorney Amy Marx of the New Haven Legal Assistance Association Tuesday accused the city of court shopping and of invoking a “frivolous” attempt to delay injunctive relief and shift the blame to the landlord.

The legal association has accused the city of “failing to ensure proper lead poisoning prevention and control, as required by state and city law since 2008.”

At that time, a child living at 1323 Whalley Ave. was found to have a seriously elevated blood lead level.
